Domain Buyers Club - Terms of Service
The following terms and conditions govern membership in our Domain Buyers Club. The Club is owned and operated by Domainate. Membership in the Domain Buyers Club is offered subject to your acceptance without modification of all of the terms contained herein and all other operating rules, policies and procedures that may be published from time to time by Domainate.
Please read this Agreement carefully before signing up for Membership. By signing up for Membership, you agree to become bound by the terms of this agreement. If you do not agree to all of the terms, then you may not join the Domain Buyers Club. All applicants to the Domain Buyers Club must be the legal age of the majority for the country in which the applicant resides.
- Your Domain Buyers Club Account
- If you login or create an account with the Domain Buyers Club, you are responsible for maintaining the security of your account.
- You are fully responsible for all activities that occur under the account and any other actions taken in connection with your account.
- You must not describe your Membership in the Domain Buyers Club in a misleading or unlawful manner.
- Domainate may terminate any account that it considers to be engaging in inappropriate conduct.
- You must not share or reveal your login information with any third parties. Accounts showing multiple login access may be flagged and either suspended or locked.
- If you require persons other than you to have access to your account, please let us know at info@domainate.com the particulars of the situation.
- You must immediately notify Domainate of any unauthorized use of your account or any other potential security breaches.
- Domainate will not be liable for any acts or omissions by you, including but not limited damages of any kind incurred as a result of such acts or omissions.
- Payment and Renewal
- By selecting a paid account option (Silver, Gold and Platinum service levels), you agree to pay Domainate the monthly subscription fees indicated for that service.
- Payments will be charged on a pre-pay basis on the day you sign up for service and will cover Membership at that level for the monthly period as indicated.
- Unless you notify Domainate before the end of the applicable subscription period that you want to cancel, downgrade or upgrade your Membership level as detailed within this Agreement, your Membership will be automatically renewed.
- If the automatic rebill fails and you have not previously contacted us to make alternate payment arrangements, your account will be downgraded to Bronze (free) level.
- Inventory
- Inventory will be comprised of newly acquired domains prior to them being offered for sale to the public.
- Domains will be added to the inventory on a daily basis as they are acquired.
- Domain Selection
- Email notices are sent out to all Domain Buyers Club members when new domains are added to inventory.
- Domains are available on a first-come, first-served basis.
- To ensure the best pricing for members, only "pushes" at the registrar where the domain is registered are available. We cannot accommodate transfers to other registrars.
- The primary registrars the Domain Buyers Club uses are GoDaddy.com, ComEtc.com (our GoDaddy reseller account) and Fabulous.com. We retain push information for club members. If we don't have it, we would contact you for it.
- Pushes are typically done within two (2) business days of receiving information enabling us to complete the transaction.
- At Domain Buyers Club, we do our best to ensure that all domains listed are currently active and not past expiration date. should it happen that a domain selected is beyond expiration date, we will renew the domain before pushing.
- By the same token, should a domain have expired and be in the redemption period, we would contact you to see if you're willing to pay the redemption fees.
- All Members must conduct due diligence to ensure domains are clear of potential trademark, copyright or any other issues before ordering. Domainate assumes no liability for omissions on the part of Members in this respect.
- Upgrades
- If you wish to upgrade your membership to a higher level for the upcoming month, please contact us at least two (2) business days before your rebill is due at info@domainate.com.
- If you wish to upgrade your membership to a higher level for the current month, please contact us at any time at info@domainate.com.
- For any upgrades, make sure not to cancel your existing subscription. We will handle this for you.
- Downgrades
- If you wish to downgrade your membership to a lower level for the upcoming month, please contact us at least two (2) business days before your rebill is due at info@domainate.com.
- Downgrades of membership for the current month are not available.
- For any downgrades, make sure not to cancel your existing subscription. We will handle this for you.
- Group Mastermind Access
- A complimentary membership to our monthly Group Mastermind is provided to all members at the Platinum level.
- Within 2 working days of when your payment has cleared, we will provide you with access.
- Returns
- All domain selections are final. No returns are allowed.
- Cancellation of Membership
- Cancellation requests must be sent in writing to info@domainate.com. If you don't receive a response within two (2) working days, please call +1.800.856.4525 (toll-free) or +1.858.240.2770 (worldwide).
- Upon cancellation of a paid membership level, accounts will revert to Bronze (free) level.
- Refunds of Membership Fees
- If you have a paid membership and have not purchased any domains within your first sixty (60) days, you can get a full refund.
- If you are past your first sixty (60) days and you have not purchased any domains, you can get a refund less a fifteen percent (15%) administration fee.
- Refunds can take up to thirty (30) days to be processed.
- Verification and Refusal of Memberships
- We reserve the right to request further information from members to verify identity before membership is approved.
- We reserve the right to refuse memberships at our discretion.
- We reserve the right to cancel existing memberships at our discretion.
- Should we exercise the right to refuse or cancel a membership, we will issue a refund in accordance with our refund policy.
- Changes
- Domainate reserves the right, at its sole discretion, to modify or replace any part of this Agreement.
- It is your responsibility to check this Agreement periodically for changes.
- Your continued use of the Domain Buyers Club following the posting of any changes to this Agreement constitute acceptance of those changes.
