Copyright and DMCA Notices
How to report copyright infringement on a site that uses a domain registered with doma.in, what a notice must contain, and how the domain holder can respond.
Last Updated
This page explains the notice process for copyright owners, their authorized representatives and domain holders who receive an infringement notice.
doma.in registers names such as example.co.fo under the extensions it operates, and publishes their nameservers in the parent zone. We do not host websites, files or email for these domains, so we cannot remove a page or a file. The content is stored by the holder’s hosting provider. We can suspend the domain’s DNS delegation, which affects access to all services using that domain.
1. Contact the Host First
The quickest way to have infringing material removed is to send your notice to the provider that hosts it. The website’s IP address and the nameservers listed in RDAP (https://rdap.cctld.com) may help identify the provider. The DNS provider and hosting provider may be different organizations. Please contact us if the host does not act, or if the site as a whole is dedicated to infringement.
2. Sending a Notice
We accept notices in the form set out in the US Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(3), and notices under the law of other countries that give the same information. Please email [email protected] with the subject “Copyright notice” and the domain name. The notice must include:
- the physical or electronic signature of the copyright owner or a person authorized to act for them;
- identification of the work you believe is infringed, or a list if there are several;
- identification of the infringing material, with the full URLs where it appears;
- your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.
3. Review Process
We review each notice and send it to the domain holder. If the infringement is clear and continues, or if the site is dedicated to infringement, we may put the domain on hold (serverHold) so that it stops resolving. A domain on hold stays registered with its holder.
We do not give the holder your contact details unless the notice requires it or you agree. A counter-notice, if one is sent, is forwarded to you.
4. Counter-Notice
A holder whose domain was put on hold because of a notice, and who believes this was a mistake, can send a counter-notice to [email protected]. It must include:
- your physical or electronic signature;
- the domain and the material concerned, and where it appeared before we acted;
- a statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled as a result of mistake or misidentification;
- your name, postal address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the notice.
We forward the counter-notice to the person who sent the notice. If they do not tell us within 10 business days that they have filed a court action against you, we may lift the hold within 10 to 14 business days of receiving the counter-notice.
5. Repeat Infringers
Under the Terms of Service, we may disable the account of a holder whose domains are the subject of repeated valid notices.
6. False Notices
Under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Consider whether the use may be lawful, for example as fair use, before you send a notice.
